Terms & Conditions

Pedaltours Ltd shall not be held responsible for any damage, expense or inconvenience caused by late arrival of public transport, change of schedule, strikes, vehicle breakdown, Acts of God, or other conditions. The right is reserved to alter the itinerary should it be deemed necessary.

Pedaltours acts solely as an agent in securing accommodation and, where applicable, public transport, and shall not be held liable in the event of any failure by any person or company to render transportation, accommodation or other service.

Pedaltours reserves the right to resell tour space without notice if the final payment has not been received by the due date. The right is reserved to decline, to accept or retain at any time any participant in any tour. All tours operate with a minimum of four participants (minimum of six for Vietnam). We reserve the right to cancel tours if the minimum number is not achieved.

In any adventure activity, there is an element of risk involved. Risks in undertaking this activity include traffic, accidents, etc.

The staff and management of Pedaltours take all practicable steps to identify and minimise potential dangers. However, you must follow our instructions and obey the road rules at all times. In particular, make yourself familiar with the bike’s brakes. Adults accompanying any person under the age of 18 must ensure that the underage person follows our instructions at all times. You must release or indemnify Pedaltours and our staff against any liability we incur to anyone else, resulting from your failure to follow our instructions or the failure of any person accompanying you under the age of 18 to follow our instructions.

We reserve the right to withdraw any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel the day’s cycling if we become concerned for any reason for your safety or that of any other person.

We strongly recommend that all cyclists have full insurance covering any injury they might suffer, including medical treatment cover, before undertaking this activity. Evacuation insurance is compulsory in Vietnam.
To the extent permitted by law, all our liability for disruption to travel plans or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993. Clients are required to take reasonable care of their belongings.
Please list on booking form any medical conditions or other information we need to know to include you safely in this activity. For example: asthma, allergies, heart conditions, epilepsy or pregnancy. You are entitled to access any information we hold about you or to request its correction at any time.

Cancellations

If it is necessary to cancel a reservation, the following will apply:

Cancellation more than 60 days of departure – No cancellation charges. Admin fee of NZ$100.

Cancellation from 59 to 45 days before departure – Cancellation charges of 100% of deposit.

Cancellation from 44 to 30 days before departure – Cancellation charges of 50% of the tour package.

Cancellation after 29 days before departure – Cancellation charges of 100% of the tour package.

There will be no refunds once a tour has commenced. We strongly recommend you take out travel, accident, medical, baggage and cancellation insurance

Medical treatment as a result of an accident within New Zealand is partially covered by New Zealand’s Accident Compensation scheme but some hospital costs must be met by participant.

Terms & Conditions - For renting

We will do everything to ensure that your rental experience is a success and that you have a great time. Please read the following terms and conditions to ensure that you know exactly what our (and your) responsibilities are.

1. Use of the bicycle and trailer
The renter accepts the bicycle and or trailer in good condition, and commits himself/herself to return them in equally good condition, and to use the bike and the trailer respecting the rules and obligations outlined in New Zealand’s laws, as well as committing himself/herself:

1. Not to adjust or manipulate the mechanical parts of the bicycle and the trailer.

2.Park them in a manner that is safe for pedestrians and where theft is minimized (e.g., no dark alleys).

3. To return them to Pedaltours at the time and date indicated on the contract. A late return will be charged according to the extra time they were used.

4. The renter is responsible for any loss or damage to the equipment, which always remains the exclusive property of Pedaltours. If the equipment is lost, destroyed, or damaged beyond repair in the judgment of Pedaltours, the renter agrees to pay Pedaltours the value to replace it. The replacement charge will be determined by Pedaltours and charged at the time of the rental.

2. Charges for use / Insurance
We recommend that you are adequately insured. We cannot be responsible for your own illness or injury or for damage or loss of your personal belongings while on a ride or tour. It is also recommended that this insurance cover you in the event of the cancellation of your trip.

The renter agrees to pay for the rental of the trailer the first $500 towards any repair or claim.

The renter agrees to pay for the rental of the bike and any additional fee that is applicable for any mistreatment of the bicycle. In case a part of the bicycle is broken because of mistreatment, loss or stealing, the following additional fees will be charged:
Stolen or completely damaged trailer or bike (when they can no longer be used) the charge will be the official price of a new replacement
-Brake levers $100
-Chain $50
-Damaged brake pads $25
-Damaged front or rear disc $50
-Damaged tyre $50
-Damaged rear derailleur $60
-Damaged front derailleur $40
-Damaged pedal $40
-Damaged carrier $50
-Damaged front or rear wheel $75
*Price list includes necessary work to change damaged/broken parts and GST.

3. Repairs and maintenance

Don’t abandon the bicycle in case of a breakdown. Contact us immediately to arrange to exchange it for one of equivalent or superior quality. The renter shall pay for all repairs needed as a result of using the equipment, including all parts.

4. Accidents and release of liability
The client agrees that he/she will release Pedaltours from any and all responsibility or liability for injuries or damages to the user of the equipment listed on this form or to any other person.

The client accepts full responsibility for the care of this equipment and thereby agrees to freely and expressly assume and accept any risks and all injury to the user of this equipment while bicycling.

5. Confirmation of Acceptance
By renting a bike from Pedaltours, you are acknowledging that you have read our terms and conditions and that you agree to be bound by them. In the event that the participant is under the age of consent (18 years of age), then I hereby certify that I am the parent or guardian of the minor, and do hereby give my consent without reservation to the foregoing on behalf of this individual.
